1. Acceptance of Terms

By downloading, installing, or using any applications ("Apps") developed by Somee Lab, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Apps.

2. Changes to Terms

  1. We may revise these Terms to the extent permitted by applicable law.
  2. When we make changes, we will post the revised Terms and effective date on our website before the changes take effect.
  3. If a change materially affects users, we will make reasonable efforts to provide prior notice (generally 7 days; 30 days for changes that materially disadvantage users) and obtain additional consent where required by law.
  4. If you do not agree to the revised Terms, you may stop using the Apps.

3. Service Availability and Changes

  1. We provide the Apps as software services and may release updates, improvements, or fixes from time to time.
  2. The Apps are provided "as is", and we do not guarantee uninterrupted availability.
  3. We may modify, suspend, or discontinue part of the Apps for maintenance, security, operational needs, legal compliance, or platform policy changes.
  4. If a change materially affects users, we will make reasonable efforts to provide notice in advance, except where urgent security or similar circumstances require faster action.

4. Use License and Restrictions

You are granted a limited, non-exclusive, non-transferable license to use our Apps for personal, non-commercial purposes. You may not:

  • Reverse engineer, decompile, or disassemble our Apps except where applicable law permits it
  • Reproduce, distribute, or sell our Apps without authorization
  • Use our Apps in any manner that violates applicable law

5. Intellectual Property

All content, design, and code within our Apps remain the intellectual property of Somee Lab. No intellectual property rights are transferred to you through the use of our Apps beyond the limited license granted under these Terms.

6. Bugs and Software Quality

Making completely bug-free software is nearly impossible. We cannot guarantee malfunction-free operation, including the possibility of data loss or unexpected failures. We recommend keeping regular backups of any important data.

7. Purchases and Refunds

Pricing displays, payment processing, cancellation rights, and refunds for in-app purchases are handled through the App Store operated by Apple, and Apple is the final processor of payments and refunds. Refund requests can be submitted at reportaproblem.apple.com. Before pursuing a refund, we encourage you to contact us at [email protected]; we'd like a chance to resolve the issue first.

Our Apps are digital content. Once a purchase is downloaded or use begins, withdrawal rights may be limited under applicable consumer protection law. We will clearly inform you of this at the point of purchase.

8. Disclaimer of Warranties

Our Apps are provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Apps will be error-free, uninterrupted, or that any defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Somee Lab will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the Apps. Nothing in these Terms excludes liability that cannot be limited under applicable law, including liability arising from willful misconduct, gross negligence, or direct damage caused by our fault where mandatory law provides otherwise.

Where Somee Lab is found liable, our total aggregate liability shall not exceed the amount you directly paid for the App giving rise to the claim. This cap does not apply where limitation is prohibited by applicable law.

10. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea. We will first attempt to resolve disputes through good-faith discussion. If a dispute cannot be resolved, the court with jurisdiction under applicable law will have authority over the matter.

11. Force Majeure

We shall not be liable for any interruption or damage caused by events beyond our reasonable control, including natural disasters, war, cyberattacks, government actions, or platform policy changes, except where applicable law does not permit such exclusion.

12. Severability

If any provision of these Terms is held invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
